Masturbating While Fasting Impermissible

Q: If a person whilst fasting masturbates will the fast break? If so will Qadha as well as Kaffarah become Waajib or only Qadha?


A: If one masturbates whilst fasting the fast will be nullified. Only Qadha will be Waajib. (Ahsanul Fataawa vol.4 pg.455, Fataawa Raheemiyyah vol.7 pg.262, Fataawa Mahmoodiyyah vol.15 pg.184)
NB: It is impermissible for a person to take enjoyment through masturbation or any haraam activity.
(وكذا الاستمناء بالكف) أي في كونه لايفسد لكن هذا إذا لم ينزل أما إذا أنزل فعليه القضاء كما يصرح به وهو المختار (رد المحتار على در المختار ج2 ص399)
الصائم إذا عالج ذكره حتى أمنى فعليه القضاء وهو المختار وبه قال عامة المشايخ (الفتاوى الهندية ج1 ص205)

I cannot remember how many fasts I have broken through masturbating

Q: I have read in many places that masturbating during Ramadhaan fast breaks the fast. What if the person has done a lot of masturbating and the real number of fasts is unknown even after knowing this breaks the fast. But the number of fasts he broke is unknown?

A: To the best of his ability, he should try and estimate how many fasts he had broken through masturbating in Ramadhaan. Thereafter he should keep qadha for all those fasts.

And Allah Ta'ala (الله تعالى) knows best.

خاتمة من لا يدري كمية الفوائت يعمل بأكبر رأيه فإن لم يكن له رأي يقض حتى يتيقن أنه لم يبق عليه شيء ومن قضى صلاة عمره مع أنه لم يفته شيء منها احتياطا قيل يكره وقيل لا لأن كثيرا من السلف قد فعل ذلك لكن لا يقضي في وقت تكره فيه النافلة والأفضل أن يقرأ في الأخيرتين السورة مع الفاتحة لأنها نوافل من وجه فلأن يقرأ الفاتحة والسورة في أربع الفرض على احتماله أولى من أن يدع الواجب في النفل ويقنت في الوتر ويقعد قدر التشهد في ثالثته ثم يصلي ركعة رابعة فإن كان وترا فقد أداه وإن لم يكن فقد صلى التطوع أربعا ولا يضره القعود وكذا يصلي المغرب أربعا بثلاث قعدات والاشتغال بقضاء الفوائت أولى وأهم من النوافل إلا السنة المعروفة وصلاة الضحى وصلاة التسبيح والصلاة التي وردت في الأخبار فتلك بنية النفل وغيرها بنية القضاء كذا في المضمرات عن الظهيرية (طحطاوي على مراقي الفلاح ص290)

Zawaal time

Q: What is zawal time? How much time before zohar Salaah does it start? Is there any zawal time before maghrib? If someone is reading/reciting Quran Sharif and zawal time commences, does he have to stop reading?

A: Zawaal refers to the time where the sun moves away from the zenith. When the sun is at the zenith (waqt ul istiwaa) it is impermissible to perform Salaah, however reciting the Qur'an is permissible.

أخبرنا مالك حدثنا نافع عن ابن عمر قال : دلوك الشمس ميلها (في قوله تعالى أَقِمِ الصَّلَاةَ لِدُلُوكِ الشَّمْسِ إِلَىٰ غَسَقِ اللَّيْلِ وَقُرْآنَ الْفَجْرِ إِنَّ قُرْآنَ الْفَجْرِ كَانَ مَشْهُودًا ﴿الإسراء: ٧٨﴾)
أخبرنا مالك حدثنا داود بن الحصين عن ابن عباس قال : كان يقول : دلوك الشمس ميلها وغسق الليل اجتماع الليل وظلمته قال محمد : هذا قول ابن عمر وابن عباس وقال عبد الله بن مسعود : دلوكها غروبها وكل حسن (موطا امام محمد ص408)

Muslim woman marrying a non-muslim man

Q: Is it permissable for a Muslim Woman to marry a non-muslim man?

A: No, it is impermissible. If a Muslim woman performs a nikah with a non-Muslim man, the nikah is invalid in Islam and they will be perpetually living in zina.

And Allah Ta'ala (الله تعالى) knows best.

وَلَا تَنكِحُوا الْمُشْرِكَاتِ حَتَّىٰ يُؤْمِنَّ وَلَأَمَةٌ مُّؤْمِنَةٌ خَيْرٌ مِّن مُّشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنكِحُوا الْمُشْرِكِينَ حَتَّىٰ يُؤْمِنُوا وَلَعَبْدٌ مُّؤْمِنٌ خَيْرٌ مِّن مُّشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَـٰئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّـهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَ ﴿البقرة: ٢٢١﴾

Question: Is it a must in Islam to break their virginity? Please answer with an authentic hadith. Please reply as soon as possible.


Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Since question has two states one with marriage and another without marriage, as without marriage this state is Haraam we are re-framing the question as 
"Is marriage a MUST in Islam? "
             
Anas ibn Malik, May Allah be pleased with him, said “A group of people came to the houses of the wives of the Prophet[pbuh], may Allah bless him and grant him peace, to ask about the worship of the Prophet[pbuh]. When they were told, it seemed that they thought that the amount was not sufficient. They said, ‘Where are we in relation to the Prophet[pbuh]?’Allah has forgiven him his past and future errors,’ One of them declared, ‘As for myself, I will pray all night,’ Another said, ‘I will fast continually and never break it.’ Another said, ‘I will withdraw from women and never marry.’ The Messenger of Allah, may Allah bless him and grant him peace came to them and said, ‘Are you the people who said such and such? By Allah, I have more fear of Allah (Taqwa) than you and more awareness of Him, but I fast and break the fast, pray tahajjud and sleep, and marry women. Anyone who is averse to my Sunnah is not from me.’”  (Bukhari and Muslim)

Nikah is "Sunnate Muwakkida", the one who leaves it will be considered sinner. [Fatawa Shaami Jild(volume) No. 4, Pg 65]

The Holy Prophet[pbuh] placed emphasis (takeed) on the Nikah, and desliked celibacy (Tanhaayi ki zindagi). [Muslim Jild No.1, Pg 449]

The Prophet[pbuh] has clearly forbidden people from celibacy: "There is no celibacy in Islam" [Sahih Bukhari]


Similarly Allama Najmul Misri says: Nikah is Sunnah, and Near Indattaukaan (Scholars of Salafussaliheen) Its Waajib . (Al bahrurrayiq Jild No.3, Pg 144)
